CONSTITUTIONALITY OF CALIFORNIAN'S POULTRY FACILITY REGS UPHELD

A federal court judge in Los Angeles has upheld the constitutionality of California's Proposition 2.

Prop 2 is the voter initiative, passed in 2008, that requires larger cages for egg-laying hens. It also regulates the housing of sows and veal calves.

A Riverside County, California egg farmer had challenged Prop 2, saying that it violates the due process clause because it didn't specify cage sizes and was therefore too vague for egg farmers to understand. The farmer also argued that it violates the commerce clause of the Constitution because it imposes burdens on interstate commerce.

Acting on motions filed by the Humane Society of the United States and the California attorney general, U.S. District Court Judge John Walter dismissed the case. He said the language that says caged chickens must be able to stretch their wings is not vague and that the plaintiff failed to demonstrate burdens on commerce.

The Prop 2 provisions take effect on January 1st of 2015.
