BAYER CROPSCIENCE COMMENTS ON NO.CAROLINA COURT DECISION IN DOW AGROSCIENCE'S CASE

Bayer CropScience regrets the decision issued by the Middle District of North Carolina ordering Bayer to pay attorneys' fees and costs to two companies that are affiliates of Dow AgroSciences LLC for patent litigation that began in 1995 related to insect resistant crops.

Bayer disagrees with the original decision from a Missouri Federal District Court finding the patents unenforceable, as well as the resulting more recent decision in North Carolina, particularly in light of recent Federal Circuit case law more clearly defining what does and does not render a patent unenforceable.

Bayer is currently studying the decision and will be considering its options.
