ATTORNEY REPRESENTING PLAINTIFFS COMMENTS ON SUPREME COURT RULING

In a 7-2 ruling, the Court held that federal pesticide law (FIFRA) preempts state-law failure-to-warn claims seeking to require cancer warnings on EPA-approved Roundup labels, handing Monsanto/Bayer a major legal victory.
The stakes are substantial. According to Brent Wisner, attorney and managing partner, Wisner Baum LLP, a nationally recognized plaintiffs' law firm. He tried the first cases against Monsanto in 2018 and secured more than $2.3 billion in verdicts.
Wisner said, "Bayer has already paid more than $10 billion to resolve claims that its Roundup weedkiller caused cancer. More than 60,000 cases were pending in U.S. courts when the Supreme Court took up this case. Now the fate of those cases remains to be seen.
"The courtroom has historically been one of the few places where evidence and truth can outweigh corporate power. This decision is a severe blow to holding corporations accountable", said Wisner.
"This is not the outcome we wanted from the Supreme Court, but it means there is more work to be done" Wisner concludes.
